FTC and Others Move Closer to Suing Google

Google獨大 恐面臨美政府反壟斷訴訟

美國聯邦貿易委員會(FTC)與Google公司間因其網路搜尋業務涉嫌違反反托拉斯法的對立情勢進一步升高,據紐約時報報導說,FTC可能建議美國政府對Google提出反托拉斯訴訟。

爭點 是否觸犯反托拉斯法
美 國政府對Google的反托拉斯調查,是自一九九○年代晚期美國政府對微軟提出歷史性反托拉斯訴訟以來,針對民間企業所進行最深入的調查。FTC主要調查 焦點在於Google是否透過其搜尋引擎搜尋結果偏袒自家產品,並阻撓競爭對手產品出現在搜尋結果網頁的明顯位置。Google十二日發表聲明指 出,Google很樂意回答監督機關對其業務提出的任何問題。

循微軟案模式
FTC 工作人員已完成逾百頁的詳細備忘錄草稿,但這並不表示美國政府一定會控告Google,FTC五位委員中必須有三位投票支持,此案才會繼續進行。但當局可 透過過程中的每個步驟向Google施壓,要求Google做出讓步與政府和解以免挨告。FTC主委萊波維茲上月表示,委員會將在今年底前做出是否控告 Google的最後決定。

歐盟、美6州政府也同步調查
Google案與過去的微軟案相當類似,正如在個人電腦產業獨大的微軟一樣,Google在大力拓展主產品網路搜尋以外的商機,如線上商務及智慧手機軟體等時,遭到對手抱怨及反托拉斯監督機構的關注。

美國政府對Google的調查與歐盟對Google的反托拉斯調查同步,此外,Google也正遭到美國德州、俄亥俄、紐約、加州、奧克拉荷馬與密西西比等六州檢察長調查。

反 托拉斯法專家表示,FTC做出建議政府提告的決定恐怕是意料中事。不過此案最可能的結果仍是和解,Google可能同意不在搜尋結果中偏袒自家產品,避免 排擠較小型競爭對手。但監督機關則可能要求Google對未來的企業手法提出保證,以確保該公司不會利用其在網路搜尋龍頭地位,在其他業務上取得不當優勢 來阻撓競爭。不過各國政府要如何在類似網路搜尋、線上商務與智慧手機等變化快速的領域中執行非歧視性原則,則仍有待考驗。
